SIA “LVSJ”, Registration No. 40203593847, Address: Imantas iela 6–6, Bauska, Latvia, hereinafter – the online store – provides the content available on the website and supplies goods/services in accordance with the Terms of Use set out below.

1. General provisions

If the consumer purchases goods/services via the website, such mutual agreement is considered a distance contract and is subject to the legal norms of the Republic of Latvia regulating distance contracts, including but not limited to the Consumer Rights Protection Law of the Republic of Latvia, the Cabinet of Ministers Regulations “Regulations on Distance Contracts”, etc.

2. Making a purchase

The prices and specifications of the products sold in the online store are indicated next to the products.

To place an order, add the desired products to the shopping cart. Fill in all the required fields and choose the most suitable delivery method. The total cost of the order with delivery is then displayed on the screen. Make the payment to complete the order.

3. Payment terms

The currency on the site is euro (EUR). It is possible to pay for purchases by choosing the following payment methods provided by the payment platform makecommerce.lv, Maksekeskus AS:

Personal data necessary for making payments is transferred to the licensed payment institution Maksekeskus AS.

The contract enters into force upon successful payment to the online store’s bank account. If for any reason it will not be possible to fulfil the order, the Buyer will be informed and the amount paid will be refunded as soon as possible, but no later than 14 days after receiving the notification.

4. Delivery terms

Goods are delivered to the following countries: [insert here the countries to which you will deliver]. All duties and taxes payable to receive the shipment at the place of delivery must be covered by the Buyer. Delivery costs are shown before confirming the order. In exceptional cases, we have the right to send the goods within up to 45 calendar days, informing the customer about this.

5. Right of withdrawal

The Buyer has the right to withdraw from the goods within 14 calendar days from the moment of receiving the goods. (Depending on the goods, the Buyer may not have a mandatory right of withdrawal; in such a case the reason must be clearly indicated and explained). The right of withdrawal does not apply if the Buyer is a legal person.

To use the 14‑day right of withdrawal, the goods may be used only for the intended purposes; the consumer is responsible for maintaining the quality and safety of the goods during the period of exercising the right of withdrawal. If the goods are used inappropriately or damaged, if the goods are handled carelessly during use or the instructions are not followed, if the original packaging of the goods is lost or if the packaging is significantly damaged, the online store has the right to reduce the refundable amount in proportion to the decrease in the value of the goods.

To exercise the right of withdrawal, you must submit a withdrawal form, which can be found here: [insert a link to the withdrawal form], by sending it to the email address info@mxkits.shop within 14 days after receiving the goods. It is good practice to provide the customer with free return shipping. This will increase trust in the online store, which will help improve sales.

The following sentence is intended for online stores that cannot offer free returns. The Buyer shall cover the costs of returning the goods, except in cases where the reason for the return is that the goods do not conform to the order (for example, incorrect or defective product).

The Buyer must, without undue delay, but no later than 14 days after sending the withdrawal form to the online store, return the goods to the Seller. After receiving the returned goods, the online store shall immediately, but no later than within 14 days, refund all payments received from the Buyer on the basis of the distance contract.

The Seller has the right to withhold the refund until it has received the goods from the Buyer or proof of return. If the Buyer has chosen a shipping method other than the cheapest type of shipment offered by the online store, the online store is not obliged to compensate the excess shipping costs.

The online store is not responsible for delays or failure to perform obligations, or any other type of non‑performance, arising from circumstances and obstacles beyond the online store’s reasonable control.

The online store reserves the right to refuse to sell the goods and to request the return of the goods from the Buyer if the price indicated in the online store is significantly lower than its market price due to an error.

6. Consumer rights regarding non‑conforming goods

The online store is responsible for non‑conformity or defects of the goods sold to the Buyer with the terms of the contract that arise within 6 months after the day of delivery of the goods to the customer, or existed at the time of delivery, unless such an assumption contradicts the nature of the goods or the defect. The Buyer must inform the Seller of the non‑conformity immediately, within 2 months after its discovery, i.e., must submit a complaint. The Buyer can submit a complaint by contacting the online store at info@mxkits.shop.

The online store is not responsible for defects that arise after the goods have been delivered to the Buyer. If the purchased goods have defects for which the Seller is responsible, the Buyer has the right to request elimination of the defects or exchange for new goods free of charge.

If the goods cannot be repaired or replaced, the Seller shall return to the Buyer all payments provided for in the distance contract. The Seller provides a written reply to the consumer’s complaint within 15 days.

7. Processing of the Buyer’s personal data

The online store processes only those personal data that the Buyer has entered when ordering the goods, such as name, surname, email, etc.

The online store transfers personal data to the transport service provider(s) in order to ensure delivery of the goods.

If you have unambiguously agreed to receive our marketing communications, including news, we may contact you from time to time by sending information about our services and latest offers. For this purpose, we may process your email address that you provided when subscribing to marketing communications. The Buyer has the option to opt out of marketing communications by notifying us by writing to info@mxkits.shop.

8. Dispute resolution procedure

In matters not provided for in these Terms and Conditions, the Buyer and the Seller undertake to comply with the regulatory enactments in force in the Republic of Latvia.

The Parties shall resolve all disputes arising between the Seller and the Buyer through mutual negotiations or correspondence. If the dispute cannot be resolved through negotiations or correspondence, the Parties shall resolve the dispute in the courts of the Republic of Latvia, in accordance with the regulatory enactments of the Republic of Latvia. Disputes between the Buyer (consumer) and the Seller may be submitted to the Consumer Rights Protection Centre or to the courts of the Republic of Latvia.

The Buyer also has the right to apply to the European Union dispute resolution bodies.
