Welcome to MXKITS.SHOP.
MXKITS.SHOP is a trading name operated by Sabiedrība ar ierobežotu atbildību “LVSJ”, registration number 40203593847, VAT number LV40203593847, with its registered address at Imantas iela 6-6, Bauska, Bauskas novads, LV-3901, Latvia.
Throughout these Terms of Service, the terms “MXKITS.SHOP”, “we”, “us”, “our” and “Seller” refer to SIA “LVSJ”.
We operate the MXKITS.SHOP online store, website and associated services, including all information, content, products, product customisation tools, features and customer services made available through the website. These are collectively referred to as the “Services”.
Our online store is hosted and supported by Shopify, which provides the e-commerce platform that enables us to offer and sell our products.
These Terms of Service, together with our Privacy Policy, Refund Policy, Shipping Policy and any other policies referenced on the website, govern your access to and use of the Services.
Please read these Terms carefully before using the website or placing an order. By accessing the website, submitting an order or otherwise using the Services, you confirm that you have read, understood and agreed to these Terms.
Mandatory consumer rights granted under applicable law are not restricted or excluded by these Terms.
If you do not agree with these Terms, you must not use the Services or place an order.

SECTION 2 - ACCESS, ELIGIBILITY AND ACCOUNTS
To place an order, you must be at least 18 years old or otherwise have the legal capacity to enter into a binding contract under the laws applicable to you.
Where a person under the age of 18 uses the Services, such use must take place with the permission and supervision of a parent or legal guardian.
You may be asked to provide information including your name, email address, telephone number, billing address, delivery address, motorcycle model information and payment details.
You confirm that all information provided by you is accurate, complete and current. You are responsible for checking all information before submitting an order.
Where you create a customer account, you are responsible for maintaining the confidentiality of your login information and for all activity carried out through your account.
You must notify us promptly if you believe that your account has been accessed or used without authorisation.
You may not sell, transfer, assign or license your account to another person.
SECTION 3 - PRODUCTS AND CUSTOM GRAPHICS
MXKITS.SHOP sells motocross graphics kits, decals, stickers and related products, including products customised according to customer instructions.
We make reasonable efforts to ensure that product photographs, mock-ups, descriptions, dimensions, colours and compatibility information are accurate. However, minor differences may occur.
Colours displayed on a screen may differ from printed colours because of screen calibration, display technology, lighting conditions, printing processes, material finish and other technical factors.
The final position, scale and appearance of graphics may vary slightly depending on the motorcycle plastics, installation method, production tolerances and selected model.
Customers are responsible for selecting the correct motorcycle manufacturer, model, production year and plastics configuration.
Before ordering, you must verify that the selected graphics kit is compatible with your motorcycle and its installed plastics. Aftermarket plastics may differ from original manufacturer plastics even when marketed for the same motorcycle model and year.
Product descriptions, prices, specifications and availability may be changed without notice. We may discontinue or limit a product at any time.
SECTION 4 - PERSONALISATION AND DESIGN APPROVAL
Personalisation may include rider names, race numbers, colours, logos, flags, sponsor marks, text or other customer-selected elements.
You are responsible for checking the spelling, numbers, colours, motorcycle details, logos and other information submitted with your order.
Where we provide a digital proof or design preview, you must review it carefully. Production may begin after you approve the proof or after the approval period stated in our communication expires.
Your approval confirms that the design details shown in the proof are correct.
Minor production adjustments may be made to accommodate cutting lines, plastic shapes, print margins, bleed areas, vents, bolt holes and technical production requirements.
After a customised order enters design or production, changes may be unavailable or may require an additional payment.
You must have all necessary permissions, licences and rights to use any logo, artwork, trademark, photograph, design or other material submitted to us.
We may refuse to reproduce content that appears unlawful, infringing, misleading, hateful, threatening, defamatory or otherwise inappropriate.
SECTION 5 - ORDERS AND CONTRACT FORMATION
Submitting an order constitutes an offer to purchase the selected products under these Terms.
An automated order acknowledgement confirms that we have received your order. It does not necessarily mean that the order has been accepted.
A binding sales contract is formed when we send an order acceptance, begin preparing or producing the product, or dispatch the order, whichever occurs first.
We may refuse or cancel an order where:

the product is unavailable;
-
payment cannot be authorised;
-
the supplied motorcycle or customisation information is incomplete;
-
the order contains an obvious pricing or product error;
-
the requested design may infringe third-party rights;
-
delivery to the stated destination is unavailable;
-
fraud, misuse or unlawful activity is reasonably suspected.
Where an order is cancelled by us after payment, the amount paid for the cancelled product will be refunded using the original payment method.
You must review your order carefully before completing checkout. Customised orders may not be cancelled after design work or production has started.
SECTION 6 - PRICES, VAT AND PAYMENT
Product prices are displayed in the currency selected or shown in the online store.
Unless clearly stated otherwise, prices displayed to consumers include VAT where applicable.
Delivery charges and other applicable charges are presented before the order is completed.
For deliveries outside the European Union, the recipient may be required to pay import VAT, customs duties, brokerage charges or other local fees. These charges are determined by the destination country and are generally not included in the product price or delivery charge.
Prices, discounts and promotions may change without notice. The applicable price is the price displayed when the order is submitted, except in the case of an obvious pricing error.
Promotional discounts may be governed by separate conditions. Unless otherwise stated, discounts cannot be combined.
You agree to provide accurate and complete payment and billing information.
You confirm that you are authorised to use the payment method submitted with the order.
Payment must be successfully authorised before the order can be accepted or produced.
SECTION 7 - SHIPPING AND DELIVERY
Available shipping methods, estimated delivery periods and delivery costs are displayed during checkout or in our Shipping Policy.
Delivery periods are estimates and may include both production time and carrier transit time.
Custom motocross graphics require design, printing, laminating, cutting, quality control and packaging. Production periods may therefore differ from standard stocked products.
We are not responsible for reasonable delays caused by circumstances outside our control, including carrier disruption, severe weather, customs procedures, border delays, strikes, natural events, equipment failure, shortages or inaccurate customer information.
We remain responsible for the goods until they are physically received by the consumer or by a third party designated by the consumer, other than the carrier.
You must provide a complete and accurate delivery address. Additional delivery costs caused by an incorrect or incomplete address may be charged to the customer.
Where a parcel is returned because it was unclaimed, refused, incorrectly addressed or could not be delivered due to circumstances attributable to the customer, we may deduct reasonable return and reshipping costs from any refund.
You must inspect the parcel and products after delivery and contact us promptly if the parcel appears damaged, incomplete or incorrect.
SECTION 8 - RIGHT OF WITHDRAWAL
Consumers purchasing non-personalised products at a distance generally have the right to withdraw from the purchase within 14 days without providing a reason.
For goods, the withdrawal period normally begins on the day the consumer or a designated third party, other than the carrier, physically receives the goods.
To exercise the right of withdrawal, the consumer must send a clear statement to mxkits.shop@gmail.com before the withdrawal period expires.
After notifying us of withdrawal, the consumer must return the product without undue delay and no later than 14 days after sending the withdrawal notice.
Unless the product is faulty, damaged or incorrect, the consumer is responsible for the direct cost of returning the product.
Returned products must be adequately packaged. The consumer may be responsible for a reduction in the value of a product resulting from handling beyond what is necessary to establish its nature, characteristics and functioning.
Where the withdrawal right applies, we will refund eligible payments, including the cost of the least expensive standard delivery method offered by us.
Additional delivery charges resulting from the customer selecting an expedited or more expensive delivery method are not refundable.
Refunds will normally be issued using the original payment method. We may withhold the refund until the returned goods are received or until the consumer provides evidence that the goods have been sent back.

SECTION 9 - PERSONALISED AND MADE-TO-ORDER PRODUCTS
The statutory right of withdrawal does not apply, to the extent permitted by applicable law, to goods made according to the consumer’s specifications or clearly personalised for the consumer.
This includes motocross graphics containing customised:
-
rider names;
-
race numbers;
-
colours selected specifically for the customer;
-
customer-provided logos;
-
sponsor logos;
-
flags;
-
custom text;
-
custom layouts;
-
motorcycle-specific modifications;
-
other individually requested design elements.
A personalised product cannot normally be returned merely because the customer changes their mind, selected the wrong motorcycle model, entered incorrect information or no longer wants the approved design.
This exception does not affect the customer’s rights where the product is defective, damaged, incorrectly produced or does not conform to the agreed specifications.
SECTION 10 - DEFECTIVE, DAMAGED OR INCORRECT PRODUCTS
Consumers retain all mandatory rights relating to goods that do not conform to the sales contract.
Consumer goods are covered by the applicable statutory conformity period, which is generally at least two years from delivery within the European Union.
A product may be non-conforming where it:
-
differs materially from the approved design;
-
is produced for a different motorcycle model than ordered;
-
arrives damaged;
-
contains a production defect;
-
is missing a material component;
-
does not possess the characteristics agreed in the order.
Normal colour variations, differences caused by screen settings, minor cutting tolerances, incorrect installation, surface contamination, incompatible aftermarket plastics or normal wear are not automatically production defects.
To report a problem, contact mxkits.shop@gmail.com and provide:

the order number;
-
a description of the issue;
-
photographs of the product;
-
photographs of the packaging where relevant;
-
the motorcycle model and year;
-
any other information reasonably required to assess the claim.
Depending on the circumstances and applicable law, an appropriate solution may include repair, replacement, price reduction or refund.
Do not install or further use a product after discovering a possible defect where doing so could increase the damage or prevent proper assessment.
SECTION 11 - INSTALLATION AND PRODUCT USE
Graphics must be installed on clean, dry, grease-free and suitable motorcycle plastics.
Installation results depend on surface preparation, temperature, technique, plastic condition and compatibility.
Unless installation services are expressly included in the order, the customer is responsible for installing the graphics or arranging professional installation.
We are not responsible for installation damage caused by improper preparation, excessive heat, stretching, cutting, contamination, incorrect positioning or installation on unsuitable plastics.
Motocross graphics are exposed to pressure washing, mud, stones, fuel, oils, friction, ultraviolet radiation and temperature changes. Normal wear resulting from use is not considered a manufacturing defect.
Customers must follow any installation and care instructions supplied with the product.
SECTION 12 - INTELLECTUAL PROPERTY
The website and its contents, including text, original graphics, layouts, photographs, videos, product presentations, designs, logos and software, are owned by or licensed to SIA “LVSJ” and are protected by applicable intellectual property laws.
You may use the website only for personal and lawful purposes.
Without our written permission, you may not reproduce, copy, modify, distribute, publish, commercially exploit, scrape, download or create derivative works from our original content.
The MXKITS.SHOP name, logo and original designs may not be used in a manner that suggests affiliation, endorsement or ownership without written authorisation.
Motorcycle manufacturer names and trademarks, including KTM, Husqvarna, Honda, Yamaha, Kawasaki, Suzuki, GasGas and other marks, belong to their respective owners.
References to motorcycle manufacturers and models are used to identify product compatibility.
Unless expressly stated otherwise, MXKITS.SHOP and SIA “LVSJ” are independent businesses and are not affiliated with, sponsored by or endorsed by the motorcycle manufacturers whose names or models may appear on the website.
Where a customer supplies a logo, trademark, image or design, the customer confirms that they have permission to use and reproduce it.
The customer agrees to be responsible for claims resulting from materials supplied by the customer where those materials infringe third-party rights.
SECTION 13 - OPTIONAL THIRD-PARTY TOOLS
The Services may provide access to tools, payment services, applications or features operated by third parties.
We may not control or monitor these third-party services.
Third-party tools are provided subject to the provider’s own terms and privacy policies.
Your use of optional third-party tools is at your own discretion and risk.
We are not responsible for third-party services to the extent that responsibility rests with the relevant provider under applicable law.
New tools, functions or services added to the website may also be subject to these Terms.
SECTION 14 - THIRD-PARTY LINKS
The website may contain links to websites or services operated by third parties.
We do not control and are not responsible for the content, availability, security, products, services or privacy practices of third-party websites.
A link does not necessarily constitute endorsement.
You should review the applicable terms and privacy policies before using a third-party service or completing a transaction with a third party.
Questions and claims concerning third-party products or services should be directed to the relevant provider.
SECTION 15 - RELATIONSHIP WITH SHOPIFY
The MXKITS.SHOP store is powered by Shopify, which provides the technical e-commerce platform used to make the Services available.
Sales made through MXKITS.SHOP are concluded directly between the customer and SIA “LVSJ”.
Shopify is not the seller of MXKITS.SHOP products and is not responsible for product design, production, fulfilment, shipping, refunds, customer service or conformity of the products sold by SIA “LVSJ”.
Nothing in this section limits any rights or remedies that cannot legally be excluded.
SECTION 16 - PRIVACY AND PERSONAL DATA
Personal data collected through the Services is processed in accordance with our Privacy Policy and applicable data protection laws.
Information may be processed for purposes including:

processing and delivering orders;

providing customer support;
-
preparing customised designs;
-
processing payments;
-
preventing fraud;
-
maintaining website security;
-
meeting accounting and legal obligations;

sending marketing communications where permitted.
Because the store is hosted by Shopify, certain personal data may be processed by Shopify and other service providers acting on our behalf.

SECTION 17 - FEEDBACK, REVIEWS AND SUBMISSIONS
If you submit a review, suggestion, photograph, testimonial or other content, you confirm that you have the right to submit it.
You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display the submitted content for operating, improving and promoting MXKITS.SHOP, subject to applicable privacy and consumer protection laws.
We are not required to publish or retain submitted content.
We may remove content that is unlawful, misleading, offensive, defamatory, infringing, fraudulent, irrelevant or otherwise inappropriate.
Reviews must reflect genuine experiences and must not contain false information, malware, confidential information or content that violates third-party rights.
We will disclose or handle incentivised reviews in accordance with applicable law.
SECTION 18 - ERRORS, INACCURACIES AND OMISSIONS
The website may occasionally contain typographical errors, technical inaccuracies or omissions relating to product descriptions, compatibility, pricing, promotions, availability, delivery charges or delivery estimates.
We may correct errors and update information at any time.
Where an obvious error materially affects an order, we may contact the customer to confirm the corrected information or cancel the affected part of the order and issue an appropriate refund.
Nothing in this section limits mandatory consumer rights or permits us to change an already concluded contract without a lawful basis.
SECTION 19 - PROHIBITED USES
You may use the Services only for lawful purposes.
You must not use the Services:

for unlawful, fraudulent or malicious activity;

to violate applicable laws or regulations;

to infringe intellectual property, privacy or other rights;

to submit false or misleading information;

to impersonate another person or organisation;

to distribute malware, viruses or harmful code;

to interfere with website security or functionality;

to attempt unauthorised access to systems or accounts;

to collect personal information without a lawful basis;

to send spam, phishing messages or unsolicited promotions;

to scrape, copy or systematically extract website content without permission;

to circumvent security, rate limits or access restrictions;

to harass, threaten, abuse or defame another person.
We may restrict or terminate access where we reasonably believe these Terms have been violated.
SECTION 20 - AUTOMATED SYSTEMS AND AGENTS
Automated systems, bots, artificial intelligence agents and similar tools must not access or interact with the Services in a way that:

conceals their automated nature;

bypasses technical restrictions;

circumvents CAPTCHAs or security measures;

overloads the website or infrastructure;

extracts protected content;

submits fraudulent or unauthorised orders;

interferes with other customers’ use of the Services.
We may use technical measures to restrict automated access.
This section does not prohibit ordinary search-engine indexing or lawful accessibility tools.
SECTION 21 - SUSPENSION AND TERMINATION
We may suspend or terminate access to the Services where reasonably necessary to protect the website, customers, third parties or our legal rights.
Termination does not affect obligations or rights arising before termination, including payment obligations, intellectual property rights, liability provisions and dispute resolution provisions.
We may refuse future orders from customers who repeatedly engage in fraud, payment abuse, chargeback abuse, harassment or serious violations of these Terms.
SECTION 22 - WARRANTIES AND LIABILITY
We provide products and Services with reasonable care and in accordance with the specifications accepted as part of the order.
Nothing in these Terms excludes or limits:

mandatory consumer rights;
-
liability for fraud or fraudulent misrepresentation;
-
liability for intentional misconduct;
-
liability for personal injury or death where exclusion is prohibited;
-
any other liability that cannot legally be excluded or limited.
We are not responsible for indirect losses that were not reasonably foreseeable when the contract was formed.
For customers acting in the course of business, and to the maximum extent permitted by law, our aggregate liability relating to an order will not exceed the amount paid for the product giving rise to the claim.
We are not responsible for losses caused by:

incorrect information supplied by the customer;

selection of an incompatible motorcycle model or plastics set;
-
unauthorised use of third-party logos supplied by the customer;
-
improper installation;
-
normal wear;
-
modification of the product after delivery;
-
circumstances outside our reasonable control.
Consumer rights relating to defective or non-conforming goods remain unaffected.
SECTION 23 - INDEMNIFICATION
To the extent permitted by law, customers acting for business purposes agree to indemnify SIA “LVSJ” against reasonable third-party claims arising directly from:

content or logos supplied by the customer that infringe third-party rights;
-
unlawful use of the Services;
-
material violation of these Terms;
-
fraudulent or intentionally harmful conduct.
This section does not impose obligations on consumers that would be unfair or unenforceable under applicable consumer law.
SECTION 24 - COMPLAINTS AND DISPUTE RESOLUTION
Customers should first contact us at mxkits.shop@gmail.com and provide the order number and a clear description of the issue.
We will attempt to resolve complaints fairly and within a reasonable period. Where required under Latvian consumer law, a written response or proposed solution will be provided within the applicable statutory period.
If a consumer dispute cannot be resolved directly, the consumer may contact the Latvian Consumer Rights Protection Centre or an appropriate recognised out-of-court consumer dispute resolution body.
Consumers may also bring a claim before a court with jurisdiction over the dispute.
The discontinued European Online Dispute Resolution platform is not used for complaints.
SECTION 25 - GOVERNING LAW
These Terms and contracts concluded through MXKITS.SHOP are governed by the laws of the Republic of Latvia.
Where the customer is a consumer residing in another European Union or European Economic Area country, this choice of law does not deprive the consumer of mandatory protections granted by the laws of their country of habitual residence.
Disputes involving business customers are subject to the jurisdiction of the courts of the Republic of Latvia, unless the parties agree otherwise in writing.
Consumer jurisdiction rights granted under mandatory law remain unaffected.
SECTION 26 - SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be applied to the maximum extent permitted or removed to the minimum extent necessary.
The remaining provisions will continue in effect.
SECTION 27 - WAIVER AND ENTIRE AGREEMENT
A failure or delay in enforcing a provision of these Terms does not constitute a waiver of that provision or any other right.
These Terms, together with the policies referenced on the website and the information confirmed during checkout, form the agreement between the customer and SIA “LVSJ” concerning the relevant purchase.
Where a specific written agreement or confirmed custom quotation conflicts with these Terms, the specific written agreement or quotation will take priority for the relevant matter.
SECTION 28 - ASSIGNMENT
Customers may not transfer their contractual rights or obligations to another person without our consent, except where such transfer is permitted by mandatory law.
We may transfer our rights or obligations as part of a lawful business transfer, restructuring or transfer of the MXKITS.SHOP operation, provided that consumer rights are not reduced.
SECTION 29 - CHANGES TO THESE TERMS
The current version of these Terms is available on this page.
We may update these Terms to reflect changes to the Services, business operations, payment methods or legal requirements.
Changes apply from the effective date stated in the updated Terms.
Changes will not retroactively alter an already concluded order unless required by law or expressly agreed with the customer.
